    New Amendment to Homoeopathy Central Council MSR Regulation 2013

    No.12-15/2012-CCH (Pt.I).—In exercise of the powers conferred by section 12C and clause (j) of section 33 of the Homoeopathy Central Council Act, 1973 (59 of 1973), the Central Council of Homoeopathy, with the previous sanction of the Central Government, hereby makes the following regulations further to amend the Homoeopathy Central Council (Minimum Standards Requirement of Homoeopathic Colleges and attached Hospitals) Regulations 2013 namely:


    In the Homoeopathy Central Council (Minimum Standards Requirement of Homoeopathic Colleges and attached Hospitals) Regulations 2013, in regulation 3, for sub-regulations (4) to (9), the following regulation shall be substituted, namely:


    “(4) The existing colleges and their attached hospitals established under section 12A of the Act and those colleges and their hospitals established prior to 28th January, 2003 and recognized by the Central Council of Homeopathy shall obtain the permission of the Central Government on or before the 17th May, 2019 subject to the fulfillment of 
    the following, namely:


    (i) the applications in Form-1, shall be submitted to the Secretary to the Government of India, Ministry of Ayurveda, Yoga and Naturopathy, Unani, Siddha and Homoeopathy (AYUSH).


    (ii) the existing Homoeopathic medical college shall be eligible for making an application if

    (a) the Homoeopathic medical college and its attached hospital shall comply the requirements as specified in regulation 4;

    (b) permission of the concerned State Government has been obtained at the time of establishment of the Homoeopathic Medical College and the status of said permission;

    (c) affiliation from a University established under any Central or State Act has been obtained for running the Degree or Post Graduate Degree Course(s) in Homoeopathy and the status of the said affiliation;


    (d) the homoeopathic college and attached homoeopathic hospital shall conform to all minimum standards of requirement as specified in regulations 5 to 13.

    (iii) the application to be submitted shall be accompanied by a fee of two lakh rupees (non-refundable) in the form of a demand draft or pay order payable in favour of "Central Council of Homoeopathy", New Delhi.

    (iv) on receipt of the application from the Central Government, the Central Council shall examine it suitably and conduct an inspection of the Homoeopathic Medical College and Hospital to verify whether the provisions of the Act and the regulations made thereunder have been fulfilled and then submit the recommendations of the Executive Committee of the Council in Form - 2 to the Central Government.

    (v) the Central Government, after considering the recommendations of the Central Council and on being satisfied that the application is in order, shall issue a letter of permission and in the event, the Central Government is to come to the conclusion that the applicant college is not fit to be continued, order of denial shall be passed after giving a reasonable opportunity of being heard to the applicant.

    (vi) the provisions of section 12B of the Act shall apply to the homoeopathic medical colleges which fail to obtain permission within the time specified in section 12C of the Act.”.
